Loss of Income - Employed

​It is often thought that calculating income loss for employed individuals should be among the most straightforward calculations in a personal injury matter. However, this may not be the case in many situations. For example, determining the value of employee benefits can add a considerable amount of complexity to the calculations. Another layer of complexity is added if the plaintiff is in receipt of collateral benefits, like Canada Pension Plan disability benefits and short and long-term disability benefits, since they each often interact with each other and the amount of these benefits tends to change over time.

Calculating loss of income for employed plaintiffs may also require that we consider additional sources of income, like overtime pay, shift premiums, bonuses, etc., which are paid in addition to regular employment income and which can vary over time.
